Consumer Rights for Michigan Drivers

According to the Michigan Department of Insurance and Financial Services, the Michigan Insurance Code grants you the right to pay benefits from your insurance. If you must file an auto insurance claim, the insurance company is legally required to acknowledge your claim within 30 days and let you know if further information is needed. The company must pay whichever part of the claim is supported by the proper information. As soon as the rest of the information is received, the insurance company must pay the claim amount balance as soon as the required documentation is received.

Once all of the supporting documentation is on file, if your auto insurance claim isn’t paid within 60 days, the claim payment is considered overdue. Properly documented PIP (personal injury protection) claims are due within 30 days. According to the Michigan Department of Insurance and Financial Services, interest on overdue auto insurance claims may be eligible for payment of 12% interest.
